No. Texas has banned the sale and marketing of THC vapes, including hemp-derived THCA carts, since September 1, 2025. Selling one is a Class A misdemeanor under Senate Bill 2024.

If you’ve seen THCA carts listed for Texas, that’s why they keep disappearing. Here’s where things stand as of October 2026.

What does SB 2024 ban?

SB 2024 makes it illegal to market or sell any vape that contains cannabinoids. That includes THC and delta-8, even when those ingredients come from legal hemp. The penalty is up to a year in jail and a fine of up to $4,000. The same law also bans vapes made in China and vapes disguised to look like school supplies.

Is it illegal to have one?

This part is less clear. SB 2024 targets selling, not owning. But Texas has separately been tightening rules on THCA itself:

Local police don’t agree, either. Austin police have said they won’t seize products under 0.3% delta-9, while Round Rock has suggested possession could be a felony. With rules this unsettled, the safe move is not to buy or carry THCA carts in Texas.

What changes next?

A federal law signed in November 2025 redefines hemp to include THCA in its total THC count. It’s set to take effect on December 11, 2026. After that, hemp THCA products will face federal limits on top of Texas’s own.

What can Texans still use?

For now, hemp products with 0.3% or less delta-9 THC by dry weight, such as some edibles and tinctures, are still sold to adults 21 and over. Patients with qualifying conditions can also look into the Texas Compassionate Use Program.

The bottom line

Don’t order THCA carts to a Texas address, and treat anything sold locally as a legal risk. If you live outside Texas, check your own state’s rules first. Our cannabis education blog tracks these changes as they happen.
